Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed in the online shop “Rome Wisdom”. Your contractual partner is Luca Schmidt, Nagolderstraße 36, 72224 Ebhausen, Germany, email: RomeWisdomService@web.de (“we”). Deviating terms of the customer are not accepted.

2. Conclusion of contract

The presentation of products in our shop is not a legally binding offer but an invitation to place an order. By clicking the final order button at checkout you submit a binding offer to purchase the goods in your cart. Before submitting, you can review and correct all entries. We confirm receipt of your order by email immediately; this confirmation is not yet an acceptance. The contract is concluded when we accept your order by a separate email (order or shipping confirmation) or ship the goods. The contract language is English. We store the contract text; you receive the order details and these terms by email.

3. Prices

All prices are final prices. As a small business within the meaning of § 19 UStG we do not charge VAT. Shipping costs are stated in our Shipping Policy and at checkout. For deliveries outside Germany, local import duties or taxes may exceptionally apply under the laws of the destination country.

4. Payment

The available payment methods are shown at checkout. Payment is processed by the respective payment provider and is due at the time of ordering.

5. Delivery

We deliver to the EU, the United States, Canada and Australia. All items are made to order; delivery times are stated in our Shipping Policy. If a product cannot be produced, we will inform you without delay and refund any payment already made.

6. Retention of title

The goods remain our property until full payment has been made.

7. Right of withdrawal

Consumers in the European Union have a statutory right of withdrawal as described in our Right of Withdrawal. Customers outside the EU have no statutory right of withdrawal.

8. Warranty

Statutory warranty rights apply. For damaged, defective or misprinted items please contact us with your order number and a photo. Slight deviations in colour and print position due to the production process do not constitute a defect.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.

10. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.

11. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
